These terms do not govern supplier agreements or any separately identified business-to-business service.

2. Definitions

Campaign means a group-buying offer with stated products, prices, participation conditions, target and deadline.

Participation means a customer’s submission to join a campaign under its stated conditions.

Success conditions means the objective conditions disclosed before participation that must be met for the campaign purchase to proceed.

Order means the customer’s purchase of the identified goods under the conditional agreement described below.

Payment setup means providing a payment method through Stripe and completing the required authorisation or verification process.

Consumer means a person acting outside their trade, business or profession.

3. Information Before Participation

Before you confirm, we provide the information required for the purchase, including the main product characteristics, seller identity, total price, delivery conditions, payment arrangement and withdrawal information.

The campaign description and checkout conditions accepted at that time form part of the agreement.

We provide a confirmation you can retain. EU pre-contract information guidance

4. Eligibility and Customer Details

You must have legal capacity to enter the agreement.

You must provide accurate information needed to process the order and use a payment method you are authorised to use.

Goods can be delivered only to destinations available for the relevant campaign.

You should notify us promptly of errors in your information.

5. Submission and Acceptance

Under this proposed contractual model, submitting participation is an offer to purchase the specified goods subject to the disclosed campaign success conditions.

We accept through an explicit acceptance confirmation sent by email.

A message acknowledging receipt is not itself acceptance unless it expressly confirms acceptance.

The accepted purchase remains conditional until the campaign success conditions are met.

6. Conditional Payment Obligation

Before submission, the checkout must make clear that participation creates a payment obligation if the disclosed conditions are met.

No campaign purchase payment is collected at initial participation.

Providing a payment method does not remove the need to present the price and conditional obligation clearly.

7. Campaign Conditions

Each campaign identifies:

  • The goods and available options.
  • The target and counting method.
  • The deadline and time zone.
  • Any maximum participation.
  • The price and charges.
  • The success conditions.
  • Payment collection arrangements.
  • Delivery conditions.

Conditions affecting an existing order cannot be changed unilaterally to the customer’s detriment.

8. Campaign Success

A campaign succeeds when its disclosed conditions are met within the agreed period.

We notify participants and proceed with payment and fulfilment according to their accepted arrangements.

Any further authentication required by a bank does not permit us to collect more than the agreed amount.

9. Campaign Failure

If the success conditions are not met by the deadline, the conditional purchase does not proceed.

We do not collect its purchase payment.

Any temporary authorisation is cancelled or allowed to expire. The bank determines when released funds are reflected.

We do not move the customer to another campaign without agreement.

10. Voluntary Cancellation Before Success

Under the proposed Fruggals policy, you may cancel participation without a cancellation fee before the success conditions are met.

Use the Leave the Campaign button on the campaign page or contact info@fruggals.com.

This voluntary policy does not restrict statutory withdrawal or other cancellation rights.

11. Prices and Additional Charges

Prices include applicable VAT.

Delivery and other unavoidable charges are disclosed before participation is confirmed. Optional extras require agreement.

The total or any lawful method of determining it is recorded in the confirmation.

We do not increase the accepted price without your agreement.

12. Errors and Unavailable Products

If we identify an error or cannot supply the agreed goods, we contact you and explain the situation.

We do not automatically substitute a different product or charge a revised price.

Any correction, termination or remedy must comply with the agreement and applicable law. This clause does not give us an unrestricted right to cancel accepted orders.

13. Stripe Payment Setup

Payment details are collected through the Stripe payment process.

You complete the authorisation required for the selected campaign and payment method.

The scope of the authorisation is disclosed before confirmation. It does not constitute unrestricted permission to charge for unrelated purchases.

When you join, the Stripe payment form saves your payment method with Stripe for that campaign; nothing is charged yet. If the campaign succeeds, we charge the agreed amount once, without you needing to be present. For iDEAL | Wero and Bancontact, Stripe sets up a SEPA Direct Debit mandate for that later charge.

Each campaign you join saves its own payment method, and we do not use it for other purchases.

14. Payment Collection and Verification

Purchase payment is collected only after campaign success, in accordance with the payment schedule selected at checkout.

Payment-method verification, a temporary authorisation and a completed charge are different events.

Where a hold applies, we explain its amount and effect. Where later authentication is required, we provide the necessary instructions.

The full amount is charged once the campaign has closed with its goal reached, unless we agreed an advance payment of half (section 15). If a charge fails, we may retry it on the same method when the bank indicates a retry can succeed, and we email you a link to complete the payment or pay with another method.

You have 7 days to pay, counted from the day after that first email, and we remind you 2 days before the last one. If we haven't received the payment by then, the order is cancelled, nothing is charged, and you owe us nothing for it.

15. Advance-Payment Requirements

Where national law restricts mandatory advance payment, we provide a compliant option.

Under Dutch guidance, consumers cannot be required to pay more than 50% before receiving goods, although they can voluntarily choose full advance payment when a compliant alternative exists.

A credit-card option is not automatically payment after delivery merely because the cardholder’s statement is payable later. Dutch advance-payment guidance

If you prefer, you can pay at most half when the campaign succeeds and the rest when your order ships. Email info@fruggals.com before the campaign closes and we arrange it.

16. Failed Payment

If the agreed payment cannot be completed, we notify you and explain the action required.

We do not switch payment methods without authorisation.

The order treatment follows the disclosed conditions and applicable law; payment failure does not create an undisclosed penalty.

17. Delivery

The campaign identifies the destination options, charges and agreed delivery period.

The period must state the event from which it runs. A campaign deadline is not itself a delivery date.

We remain responsible for our fulfilment obligations where a supplier or logistics provider carries out delivery.

Statutory remedies for delay and non-delivery remain available.

18. Delivery Risk

For delivery arranged by us, the risk generally passes when you or your nominated recipient takes physical possession.

Any special treatment for a carrier independently commissioned by you follows applicable law.

19. Right of Withdrawal

For eligible purchases, you may withdraw without giving a reason within the statutory period.

The FAQ contains the detailed instructions, return address, cost policy and notification methods. We supply the required information and model form with the contract confirmation.

You may also exercise an applicable withdrawal right before delivery.

20. Online Withdrawal Function

We provide an accessible online withdrawal function, Withdraw From a Purchase, linked at the bottom of every page, throughout the applicable period.

It allows you to identify the purchase, submit and confirm withdrawal, and receive a prompt acknowledgement on a durable medium.

It is additional to other valid notification methods. Directive (EU) 2023/2673

21. Returns, Condition and Costs

Goods must be returned within the applicable statutory period after withdrawal notification.

Fruggals pays the direct cost of returning goods, also after a change-of-mind withdrawal. Costs required for a statutory defective-goods remedy are handled under the applicable rules.

We may assess legally permitted diminished value, but do not impose a universal unopened-packaging condition or undisclosed restocking fee.

22. Withdrawal Exceptions

A statutory exception applies only where the purchase meets its legal conditions.

We disclose relevant exceptions before purchase.

A discounted price, group purchase or successful campaign does not itself remove withdrawal rights.

23. Refunds

Withdrawal refunds are made within the legally required period.

We apply only legally permitted withholding pending return or proof of dispatch. Refunds normally use the original payment method unless expressly agreed otherwise.

The FAQ explains delivery-cost treatment and the difference between refunds and released authorisations.

24. Conformity and Guarantees

Goods must meet the agreed description and applicable conformity requirements.

We provide the remedies required by law for non-conforming goods.

Commercial warranties are additional to statutory rights. Customers are not required to pursue a manufacturer instead of exercising rights against Fruggals as seller.

25. Product Safety and Recalls

Contact us about suspected safety issues.

We communicate relevant safety notices and provide recall remedies where required.

Nothing in these terms restricts mandatory product safety obligations.

26. Complaints

Send complaints to info@fruggals.com with relevant references and details.

Our response target is two business days. If investigation takes longer, we explain the next steps.

Fruggals is not affiliated with a dispute committee or other alternative dispute resolution body. If we cannot resolve a complaint together, you can take the dispute to the competent Dutch court.

27. Responsibility and Liability

We remain responsible for the obligations placed on us by the agreement and applicable law.

Nothing excludes liability or remedies where such exclusion would be unlawful.

Involvement of a supplier, carrier or payment processor does not automatically remove our responsibility.

Unfair standard terms are not binding on consumers. EU consumer-contract guidance

28. Personal Information

Our Privacy Policy explains personal-data processing.

Accepting purchase terms is not treated as consent to unrelated marketing or optional tracking.

29. Applicable Law

Under the assumed Dutch establishment, Dutch law governs.

This does not deprive a consumer of mandatory protections afforded by the law of their habitual residence where the applicable conflict-of-law rules provide them.

30. Courts and Dispute Resolution

Customers retain access to courts available under applicable jurisdiction rules.

These terms do not impose an exclusive court arrangement that unlawfully removes consumer protections.

31. Changes to These Terms

Updated terms apply to future participation and purchases.

They do not retrospectively change existing agreements without a lawful basis and any required consent.

The applicable version is supplied with the order confirmation.

32. Saving the Agreement

You can save these terms and the confirmation for future reference.

Contact us if you need a copy of the conditions applicable to your purchase.
